‘Can’t Wait for Another Rape’: Supreme Court Strong Stand on Kolkata Doctor’s Murder

Hearing the case of a doctor who was raped and killed in a state-run hospital in Kolkata, Chief Justice DY Chandrachud of India said that the country cannot wait for another rape case before “things on the ground” change. Also, CJI Chandrachud pointed out that laws now in place do not address institutional safety requirements for physicians and other healthcare professionals.

He added that women doctors face greater discrimination as a result of patriarchal attitudes. “As more and more women join the workforce, the nation cannot wait for another rape for things to change on the ground,” he said. A 10-person task committee was then established by the Supreme Court bench to develop a nationwide policy for guaranteeing physicians’ safety and facilities.

The court ruled that stakeholder input must come before developing a national consensus. The horrific doctor’s murder had been brought to the attention of the Supreme Court suo moto. After working a 36-hour shift, the trainee doctor went to the lecture hall of the RG Kar hospital to relax when she was sexually assaulted and killed. A volunteer from the community has been detained by the police for the offense.

The Bengali government was advised today by the Supreme Court not to use its authority against doctors who are protesting. It requested that the doctors return to work and assured them that their concerns were taken very seriously. Within three weeks, the task force will present its interim report, and within two months, its final report.

Vice Admiral RK Sarian, a surgeon; Dr. Reddy, Managing Director, Asian Institute of National Gastrology; Dr. M. Srinivas, Director, AIIMS, Delhi; and Dr. Prathima Moorthy, NIMHANS, Bangalore are among the ten members of the task group. The bench declared that the ex-officio members of the national task force would be the home secretary and cabinet secretary to the Union government.
