Delhi High Court Rejects PIL for Arvind Kejriwal’s Release, Imposes ₹75,000 Costs

The Delhi High Court denied a plea on Monday asking for Arvind Kejriwal, the chief minister of Delhi, to be released on “extraordinary interim bail” in all criminal charges filed by the State and the Enforcement Directorate until the end of his term. The Aam Aadmi Party leader is under judicial detention as a result of the court’s orders, according to the court, which also assessed ₹75,000 in costs against the petitioner.

The fourth-year law student’s plea, filed under the name “We the People of India,” was deemed unmaintainable by the court since it is not within its writ jurisdiction for courts to award extraordinary temporary bail in matters that are still pending and involve allegations made against public officials. Leading attorney Rahul Mehra, representing Kejriwal, referred to the PIL as “wholly impermissible” and “misguided,” claiming the petitioner was using the court as a political platform, according to Live Law.

Pulling up the petitioner, the court inquired as to whether he had “good attendance in law school.” According to Acting Chief Justice Manmohan, “it appears he does not follow the principles of law.” The petitioner’s assertion that they are the custodian and spokesperson of the Indian people is without merit, the court said in dictating the ruling.

The court determined that it is “even more strange that the petitioner has offered to extend a personal bond in favor of Kejriwal and undertakes that Kejriwal will not influence witnesses,” noting that the petitioner does not have the legal authority to grant Kejriwal a personal bond or the ability to make such assertions.
