Delhi Court Declares ED Custody Illegal, Grants Bail to AAP’s Amanatullah Khan in Waqf Board Case
Amanatullah Khan, an MLA for the Aam Aadmi Party (AAP), was released on a bail bond of ₹1 lakh with a surety on Thursday by Delhi’s Rouse Avenue Court. This was a major defeat for the Enforcement Directorate (ED), which declared the ED’s custody of him in relation to the Delhi Waqf Board issue ” illegal.”
The court stated that even while there is sufficient evidence to move forward with the case, the chargesheet against Khan does not include the required punishments, even though it declined to take cognizance of it. Judge Jitendra Singh’s order, which was reserved after hearing the ED’s arguments, was followed by this decision.
In a 110-page supplemental charge filed on October 29, the ED claimed that Khan had laundered money earned through corrupt Waqf Board-related activities. Mariam Siddiqui was also named as a person of interest in the document, even though the ED did not charge her.

In connection with separate FIRs from the CBI and Delhi Police’s anti-corruption section concerning alleged Waqf Board irregularities and disproportionate assets, Khan was arrested on September 2 as part of an ED probe under the Prevention of Money Laundering Act (PMLA). Khan was charged by the ED of being “evasive” when being questioned.
