Delhi High Court Rejects Arvind Kejriwal’s Plea Against ED Arrest

Chief Minister Arvind Kejriwal’s request to have his arrest by the Enforcement Directorate (ED) in the excise policy case dismissed by the Delhi High Court on Tuesday was denied. The high court declared that the central agency had sufficient evidence to justify Kejriwal’s arrest. Those who were detained suffered as well from the chief minister’s delay. “Kerjriwal’s non-joining was a contributing factor, but not the only factor,” the top court declared. According to the court’s order, raising doubts or casting doubt on the approver’s statement recording process is tantamount to disparaging the judge and the court.

Additionally, the court declared that Sarath Reddy and MS Reddy made their remarks freely. The court declared that it “cannot conduct a mini-trial and step into the shoes of the trial court.” The courts are required to consider the petitioner’s arrest in the context of the law if it was not a time-sensitive matter. When the Lok Sabha elections were announced, Kejriwal would have been aware of it and would have been quite busy. “It cannot be maintained that the ED determined the timing of the arrest,” the high court judge declared.

The court further declared that, as political factors and equations have no bearing on court processes, they cannot be expanded in the legislation. The court declared, “The petitioner and the ED are the parties involved in this matter, not the Center and Kejriwal.” According to the documents and evidence presented to the court, the petitioner in this instance received full legal protection in the Pankaj Bansal case. The court declared that its order was reasoned rather than a simple command.

The Aam Aadmi Party candidate for Goa in 2022, as well as comments from an approval hawala dealer and an approval officer, were among the sufficient evidence that the high court found when dismissing the petition. Extra Solicitor General SV Raju stated, “Today the judge gave the judgment after seeing all the evidence, and the court also said that a money trail has been found,” while standing on behalf of the ED. The court rendered a decision today that declared Chief Minister Kejriwal’s arrest to be lawful.
