Supreme Court Grants Bail to BRS MLC K Kavitha in Delhi Excise Policy Scam

In the Delhi excise policy case, BRS MLC K Kavitha was granted bail by the Supreme Court on Tuesday. Because of the way the case investigation was being handled, the court criticized the Enforcement Directorate and the CBI.

Since March 15, K Kavitha, the former chief minister of Telangana, has been under arrest.

What happened during the hearing?

The Enforcement Directorate and the CBI were questioned by the Supreme Court bench of Justices BR Gavai and KV Viswanathan during the hearing to present any “material” that could support the claim that K Kavitha was involved in the alleged Delhi excise policy scam.

In support of K Kavitha, senior attorney Mukul Rohatgi requested bail, stating that the two agencies had finished their investigation into her.

He also mentioned the ruling of the supreme court, which granted AAP leader and co-accused Manish Sisodia bail.

In an appearance on behalf of the investigation agencies, Additional Solicitor General SV Raju stated that K Kavitha had formatted her cell phone. He claimed that her actions amounted to falsifying evidence.

K Kavitha’s attorney referred to the claim as “bogus.”

Afterwards, the bench posed the difficult query to the agencies’ attorney.

“What is the material to show that she was involved in the crime,” Raju replied.

What is K Kavitha accused of?

The lawmaker had filed a case appealing the Delhi High Court’s ruling refusing her bail, and on August 12 the Supreme Court had requested that the authorities submit their reply.

Kavitha’s bail requests were denied by the high court in both instances, ruling that she was initially one of the principal conspirators in the illegal conspiracy.

K Kavitha has been charged by the agencies with belonging to the so-called South Group, a group of politicians and businessmen who are said to have paid ₹100 crore in bribes to the Aam Aadmi Party in exchange for the party’s support during the creation and execution of the strategy.

Leaders of the AAP Manish Sisodia and Sanjay Singh had served jail terms for comparable offenses. Arvind Kejriwal, the chief minister of Delhi and the man the agencies refer to be the mastermind of the purported scheme, has been behind bars since March 21.
